AUTO INSURANCE - THE EFFECTS ON A
PERSONAL INJURY CLAIM
In the Washington DC Metropolitan area, there are different insurance laws at work that affect a person's ability to recover First-Party Benefits Coverage. In The State of Virginia, these benefits are referred to as Medical Payments or Medical Expense Benefits (Med-Pay), and in the State of Maryland and the District of Columbia, they are referred to as Personal injury Protection (PIP).
Several jurisdictions have different rules regarding an injured party's right to use their health insurance and when those benefits must be reimbursed. At Paul Klein and Associates, P.C., we will protect your interests and provide you the results you deserve.
PERSONAL INJURY PROTECTION (PIP) - MEDICAL EXPENSE BENEFITS (MED-PAY) - AND INCOME LOSS BENEFITS (LOST WAGES)
Personal Injury Protection (PIP) is a benefit used in the District of Columbia and Maryland that affects the injured party's right to be compensated regardless who is at fault in an automobile accident. These benefits are available to qualified individuals and used to pay medical expenses and/or lost wage benefits.
LAWS FOR PIP IN THE DISTRICT OF COLUMBIA AND THE LAWS
IN THE STATE OF MARYLAND ARE DIFFERENT
The differences are explained within each insured's policy, however it is recommended to seek the advice from an attorney prior to making any claim.
In The State of Virginia, Medical Expense Benefits (Med-Pay) are available to pay for medical bills only of individuals involved in automobile accidents in Virginia. Provided the policy is written in the State of Virginia. This type of coverage must be purchased from your automobile insurance carrier. This coverage is not included with full coverage or generally on any policy. You must purchase if additionally. Med-Pay differs from PIP, since Med-Pay cannot be used to pay lost wages. In order for a Virginia policyholder to get lost wages reimbursed, Income Loss Benefits (ILB) must be purchased and added to the policy. These benefits are not subject to subrogation or if available to a policyholder, they can claim the benefits without the need to reimburse the carrier for these payments from any personal injury settlement.
